1.1 Redballer.
Redballer is a social events community that provides fun and convenience for users all over the world to create events, source for event needs, plan event, promote, manage, sell tickets to their events or send out free invitations from the comfort of their homes and offices.
1.2 THE SERVICES.
Redballer’s websites and domains, including www.redballer.com, and all of its webpages, subdomains, country level domain variants and subparts of those websites (collectively, referred to as our “Site”), all applied rights and pending rights when acquired, all of the services available on or through the Site or otherwise provided by us, and all of our mobile applications that are offered, maintained and provided by redballer. We refer to all of these as our “Services”.
1.3 USERS.
Redballer provides a simple, convenient and quick means for registered users to create events, sell and buy tickets, source for event needs, network and share moments, we refer to ticket buyers, event Organizers, influencers, followers, friends, account holders, all registered individuals or entities and other visitors and browsers of the site collectively as “Users” or “you.”
2.1 INCORPORATION BY REFERENCE.
This trade Agreement also referred to as merchant agreement and all rights and obligations contained therein are in addition to and are incorporated into the Terms of Service by reference. Nothing in this Trade Agreement shall be deemed to modify, waive, amend or rescind any portion of the Terms of Service.
3.1 ADDITIONAL INFORMATION.
In the process of creating an event you will be required to provide additional information (beyond the information required to register for full access to the site) the additional information includes but not limited to, information about your event, the principal contact of your event host and leaders/team, event theme/title, address, location of event venue, event’s host country, description of event, website address, bank account or other payment information, Tax, date of event and time, event’s terms and condition and other personal and company information. Government issued identification card/document may be required in some cases of verification. This additional information will also be used to verify your identity, the validity of your claim and the legality of your transactions and/or whether you are qualified to trade on the service using a registered trademark in a given jurisdiction or to settle legal disputes, some other information that is presently not stated herein may be required as situation demands either by law or as a necessity for settling disputes. By using the service, you agree to provide this information in an honest manner and to constantly update the information as it changes in a timely manner and without any reservation.
3.2 FAILURE TO ABIDE.
Redballer reserves the right to ban or suspend your account or to withhold fund in your escrow account as a result of your failure to abide fully to this merchant agreement including withholding vital information or if we are convinced that information provided are not accurate or that you are operating against the provisions of this trade agreement.
Creating an account on Redballer is 100% free, creating event is free, free events are 100% free, we only charge token for services rendered to premium event creators through our professional package plan or as ticket booking fees for paid events. We support charity and fundraising events too. For charity or fundraising events please create event using the professional package we may ask few questions and if you are qualified you will get a special waiver on our fees.
We have two types of fees on Redballer
4.3 DIFFERENTIATING BETWEEN REDBALLER SERVICE FEES AND PAYMENT PROCESSING FEES
Redballer service fees and payment processing fees are two different fees.
What you see is what we charge no hidden charges. No monthly fees, No surprise billing. Redballer service fees are by default paid by the event organizer.
Redballer and the payment processors are two different entities but work as a team in making a success of your event.
4.4 OFFLINE PAYMENT AND INVOICING
We charge fees for services rendered even if your attendees choose the pay-at-event option. (The pay-at-event option will be added soon and takes effect immediately)
4.5 AGREEMENT ON REDBALLER SERVICE FEES
By using this service, you agree to these terms and fully authorize Redballer to automatically deduct its service fees from your earnings as at when due with or without prior notification and also agree that Redballer can close down, ban or suspend you wholly or from creating events on its service if you fail to pay its service fees.
PLEASE NOTE: ALL REDBALLER SERVICE FEES ARE NOT INCLUSIVE OF PAYMENT PROCESSNG FEES.
4.6 AVAILABLE FEE OPTIONS
Redballer has only two fees options on the service
Event organizers pay redballer services fees by default, in as much as we want the best for the organizers, we also want same for their event attendees, making tickets on this platform affordable is a win-win for everyone, we don’t want to make tickets on the site expensive for your event attendees by making them pay all fees associated with the event, that may discourage them, we will always charge a token so as to make payment of our fees easy and affordable for event organizers,
Event attendees pay payment processing fees associated with buying of tickets to their event, these fees are not charged by redballer, our payment processors makes it easy for the attendees to buy tickets from the comfort of their homes and offices, saves them money, time and stress that could be experienced at the point of offline sales.
4.7 WE CHARGE A TOKEN AND NOTHING MORE.
The redballer service fee posted on the event creation page is the only fee redballer charge event Organizers for services rendered on the site, which includes but not limited to tools made available for setting up the event, promotions and management. The fees only apply to paid events (ticket booking fees) we also charge additional fees for premium services offered through the professional plan, the total fees payable for premium services may vary from event to event and currency to currency. however redballer’s country or regional offices may provide additional services to event organizers within its region or country for example they may be recruited to provide customized services like attendee’s list/ticket management at the event’s venue, online event management, staff support before and during the event, etc. these services are offered by our country and regional offices to help event organizers make the best of their events and not by redballer as a platform. All agreement reached between our country or regional offices for additional services are reached between the country or regional office and the event organizer and not with redballer as a platform and as such fees payable for services rendered on the platform doesn’t cover cost of additional services provided by the country or regional offices.
4.8 PAYMENT PROCESSORS AND BANK FEES.
Redballer does not control (and thus cannot disclose) fees levied by your bank, credit/debit card company or payment processors on the service, including fees on transactions in foreign currencies or from foreign persons, cost of receiving payment to your bank, any and all cost associated with the sales or purchase of tickets. The event attendees pays payment processing fees associated with purchase of tickets but you may be responsible for cost of transfer of your earnings to your bank account either charged by payment processor or your bank in certain jurisdictions, be sure to check with your bank, Credit/debit Card Company or payment processor’s fees on transfer fees prior to creating events to understand all applicable fees, credit/debit card surcharges and currency conversion rates. We only charge fees for services rendered on redballer, nothing more.
4.9 YOUR ESCROW ACCOUNT
Your escrow account will automatically be activated for your paid events immediately after setting up tickets for your event. An escrow account is one of the ways we ensure safety and security for sellers and buyers on Redballer. Here is how it works.
Redballer escrow account verifies, ensures and confirms that payment was indeed received on every transaction carried out on your event page before orders can be made, since we are not responsible for processing payment this is one of the ways we protect fraudulent transactions on your event page. We verify payment 100% and secure your fund before your ticket will be marked sold.
Just as we will do everything possible to protect the Event Organizer from any fraudulent purchase so we will also do everything possible to protect your event attendees on Redballer, every time they make payment for an event, the escrow account holds the fund in trust until after 3 days starting from the date of delivery e.g a day after event date. Payment will only be ready for release to the Event Organizer if after the 3 days grace there was no complain of fraud, event did not hold or was cancelled or any other issue that can put our brand reputation in jeopardy (please bear in mind that you will have to request for the fund via your dashboard) but if a complaint was received within the 3 days’ time frame the escrow account will hold on to the fund until the issue is resolved.
The 3 days grace period does not replace the time frame set by the Event Organizer regarding refund policies should the need arises.
There may be a threshold that must be reached before payment will be released by the payment processor for instance you may need to earn a minimum of $100 or N100 (depending on your choice of currency) before you can be paid, this threshold is designed by payment processors and not redballer to ensure that the money in your account is enough to pay fees associated with transfer of your fund either by your bank or payment processors used in receiving your earnings, redballer doesn’t set thresholds on your earnings and we are not responsible for fees associated with fund transfers please see payment processor’s site for more information on thresholds.
By using this service, you agree to these terms.
4.10 ADVANCE PAYMENT.
Event Organizers agrees that the escrow account will only be released 3 days after service delivery regarding the applicable event however Redballer in its discretion may decide to release an advance payment from earnings prior to the period set forth in section 4.9(b) to certain Event Organizers, on such terms and conditions as set forth in this Trade Agreement or on a separate written Addendum Agreement reached between the Event Organizer and Redballer prior to the release of the advance payment. Event Organizer agrees that payments made by Redballer from earnings received from applicable event prior to the three (3) day grace after delivery of service are advance payment of amounts due to the Event Organizer under this Trade Agreement and as a result only balance payment of the total sum due from earnings received from applicable event will be released after the mandatory 3 days after service delivery grace as defined in section 4.9(b). If Redballer agrees to advance a portion of Event Organizer earnings to the Event Organizer prior to full maturity of release, Event Organizer agrees that for some reasons best known to Redballer, redballer may at any time
(ii) Alter the terms, the frequency or maximum aggregate cap of the advance payments payable to the Event Organizer.
In addition, Event Organizer agrees that Redballer may demand back such advances (or any portion thereof) from time to time at its discretion based upon the level of refunds, disputed charges, chargebacks, customer complaints, allegations of fraud, changes or credits in Event Organizer’s escrow account or the underlying event(s)’s risk profile, or breaches of our Terms of Service, terms of use, privacy policy including this Trade Agreement. Upon receipt of notice of any such demand, Event Organizer shall thereupon promptly pay back to Redballer the portion of any such advance demanded. Event Organizer fully agrees that Redballer has right to withhold funds as set forth in Section 4.9(b) of this Trade Agreement. Event Organizer also accepts its obligations under Section 4.4 and 4.5 of this Trade Agreement, including its obligations to reimburse Redballer for refunds and credit card chargebacks.
4.11 WITHHOLDING/REFUND OF PAYMENT.
Redballer will not issue an advance payment or release escrow payment to an Event Organizer for an event that was cancelled or that we believe may not hold either due to complaints received from different users regarding the event, a huge number of negative reviews from different users concerning past experience of previous events hosted by the same event creator, security reasons or for some other reasons as determined by Redballer in its discretion. If advance payment has been made before the event was cancelled or before we received complaints or escrow has been released, the Event Organizer agrees to immediately make a refund to Redballer and agrees to cover applicable processing fees and all fees associated with the refund.
4.12 RESERVES.
If at any point in time Redballer at its discretion decides to flag your event as a risky venture due to certain activities or inactivity carried out either by you or through your event page either by your administrators or event leaders/team, you agree that we reserve the right to retain a certain percentage of your earnings (the percentage to be retained will be determined at Redballer’s discretion) so as to fund a reserve in your escrow account this reserve may be used to settle refunds, customer complaints, charge backs, settle dispute charges, suspicious or fraudulent activities carried out on or through your event page, to secure and ensure that promises made to your event attendees prior to buying tickets to your events are fulfilled, protect your obligations under terms of use, terms of service and every other agreement reached before creating applicable event and any other activity that may reflect negatively on Redballer’s brand or its partners, Redballer will continue to retain the percentage following applicable event and will only release the reserve after we have been convinced beyond any doubt imaginable that the event is safe and risk free.
4.13 CHARGEBACKS AND REVERSALS.
All credit card chargebacks or other transaction reversals initiated against Redballer or its affiliates for any reason whatsoever (except to the extent they were caused solely by Redballer’s negligence or willful misconduct) with respect to an Organizer’s event or transactions carried out on or through its page or account and all related credit card association, payment processing, re-presentment, penalty and other fees and expenses incurred by Redballer or its affiliates in connection with such chargebacks shall wholly be the responsibility of the Event Organizer, by using the site you agree to promptly and fully pay for such amounts on demand. Redballer may at its discretion use commercially reasonable efforts to manage the re-presentment of such chargebacks and reversals on behalf of the Event Organizer, you hereby authorize Redballer to manage re-presentation of such chargebacks and reversals on your behalf and you agree to use reasonable efforts to cooperate with Redballer in such re-presentment. However, Redballer shall have no obligation to re-present any chargeback that it believes in its discretion may reflect negatively on its brand or affiliates or that in any way relates to a transaction that should be refunded in accordance with the Event Organizer’s refund policy or in line with redballer policy guide, you agree that Redballer’s loss of any chargeback re-presentation shall not in any way limit the Event Organizer’s obligation to pay such chargebacks.
4.14 CURRENCIES AND COUNTRIES.
Redballer presently provide full services to Event Organizers in limited countries and local currencies but that will only be for a while as we are working hard round the clock in expanding and reaching more countries and adding more currencies on the service. All event ticket fees and all transactions carried out on Redballer and held in trust by each Event Organizer’s escrow account will be released in the same currency that it was collected (except in cases where we may not be able to pay in the same currency as at the time requested due to bank/payment processor’s issues, in that case the currency will be released in the currency made available by the payment processor used in collection), for example if you sell in US dollars you will get paid in US dollars we do not provide currency conversion service, as a result you are advised to create paid event’s tickets in your local currency only or in the currency of your event’s host country. For the purpose of Ad placement and promotions Some of Redballer’s fees are in US dollars especially in countries where we presently do not offer services in their local currencies while others have the option of paying in their local currency.
4.15 REFUNDS.
(a) REFUND POLICY AND PROCESS.
Regardless of what payment method used, Event Organizers agrees to communicate a comprehensive refund policy to their event attendees with respect to each event posted on the Site in accordance with Redballer’s refund policy guide.
Event Organizers can issue refunds to Attendees directly through the service within the time frame permitted by the payment processor used in such transaction by contacting redballer to make such refunds from the escrow account on their behalf. If the refund was not made within the time frame permitted by the payment processor used in processing such transaction, then it will have to be processed manually by Redballer from the escrow account., Redballer may in its discretion decide not to process any refunds which are manual, in which case they will be processed directly by the Event Organizer.
If there is no fund in the escrow account or it has been released then the event organizer will have to make the refunds via a bank deposit with evidence of payment made available to redballer through mail to support@redballer.com
(b) REFUND DISPUTES.
Regardless of what payment method used, all disputes regarding refunds are between Event Organizer and its Attendees. Redballer may decide to mediate especially if invited or if such dispute is taking longer time to settle, but ultimately it is the Event Organizer’s obligation to settle any dispute arising from transactions carried out on its page.
(c) MANDATORY REFUNDS.
Notwithstanding the foregoing, Event Organizer authorizes Redballer to make refunds in the following situations regarding applicable event(s)
(i) If the Event Organizer specifically authorizes the refunds at the time.
(ii) Redballer believes in its discretion that specific orders should be refunded under the Event Organizer’s posted refund policy or Redballer Refund Policy guide, including without limitation, that they are required by applicable local, state, provincial, national or other law, rule or regulation or the Payment Scheme Rules governing the payment method used in such transactions.
(iii) Redballer believes in its discretion that the refund request, if not granted, will lead to a chargeback that Redballer is more likely to be subjected to.
(iv) Event Organizer failed to list a refund policy on the applicable event page and Redballer believes in its discretion that a refund would be reasonable under the circumstances.
(v) Redballer believes in its discretion that specific orders are fraudulent (e.g., made with stolen credit cards or otherwise not bona fide transactions).
(vi) Redballer believes in its discretion that the order is a duplicate.
by using the service you hereby authorize Redballer to make refunds of any and all orders (including those for unrelated events/transactions) if
(A) Redballer believes in its discretion that Event Organizer has engaged in a fraudulent activity or made any misrepresentations.
(B) Redballer believes in its discretion that there is substantial risk of non-performance or failure to deliver by the Event Organizer with respect to the applicable event or future events.
(C) Redballer believes in its discretion that it is likely to receive complaints, refund requests, transaction reversals and/or chargebacks with respect to a substantial amount of orders.
(D) Redballer believes in its discretion that Event Organizer is a Prohibited Merchant on it’s service and has used the Service to process Prohibited Transactions or to manage Prohibited event or brand or that failing to make the refunds would otherwise expose Redballer to legal liability.
Since event creations and tickets sales are ultimately made by Event Organizers, Event Organizer hereby agrees to promptly and fully reimburse Redballer and its affiliates upon demand for refunds that Redballer makes pursuant to this Trade Agreement, other than to the extent that the necessity for such refunds were caused by Redballer’s negligence or willful misconduct. Event Organizer acknowledges and agrees that chargebacks will result in losses to Redballer in excess of the amount of the underlying transaction and that by refunding transactions in advance of a chargeback Redballer is mitigating such losses and its damages with respect to Event Organizer’s breach of this Trade Agreement.
4.16 NON-EXCLUSIVE REMEDIES; TAXES.
(a) NON-EXCLUSIVE REMEDIES.
(i) In the event that Event Organizer fails to pay Redballer, amount owed pursuant to the Terms of Service (including without limitation this Trade Agreement) when due and following an invoice delivered by Redballer to notify of such sum payable within 30 days of receipt as stated in section 4.4(b), section 3.2, 4.4(c) and 4.4(d) of these Trade agreement shall apply as stated.
(ii) In the event that an amount of transaction fee is owed by an Event Organizer to Redballer under the Terms of Service (including without limitation this Trade Agreement), Redballer may, without limiting its other rights and remedies and to the extent permitted by applicable local, state, provincial, national or other laws, rules or regulations withhold any amounts due to the Event Organizer, whether for a particular event or for any other event that the Event Organizer lists through or on the Site and use the withheld amount to repay the amount owed by the Event Organizer to Redballer.
(b) Cost of Collection.
Event Organizer agrees to fully reimburse Redballer upon demand for all out-of-pocket costs and expenses, including without limitation, reasonable attorneys’ fees and expenses, incurred by Redballer as a result of collecting amounts due to Redballer from the Event Organizer under this Trade Agreement, the Terms of Service or otherwise stated on a separate written Addendum Agreement reached between the Event Organizer and Redballer.
(c) Taxes.
(i). You are solely responsible for determining which, if any, sales, use, amusement, value added, consumption, excise and all other taxes, duties, levies and charges (collectively, referred to as “Taxes”) applicable to your use of the Service and you agree that it is your sole responsibility to apply such Tax, and that you will, collect, remit and report the correct amount of all such Taxes to the applicable government authorities or organization responsible for such taxes in your event host country or jurisdiction.
Redballer provides you with tax tools that will assist you in collecting amount of tax accrued to each event but does not represent, warrant or guarantee that the Tax tools provided to you will meet all Tax requirements that may be applicable to you or that such Tax tools will result in your collection or remittance of all applicable Taxes, Taxes may vary based on the nature of your event, the nature of your Tax status (individual, entity, business, consumer, etc.), your location, the location of your Attendees, buyers, credits and deductions for which you may qualify and other factors, and you hereby release Redballer of any and all liability with respect to your use of the Tax tools and your collection of tax. If you do collect Taxes on Redballer, those Taxes will be fully credited into your escrow account together with funds accrued to you from sales of event tickets and will be released to you fully without deducting Taxes, you are responsible for remitting Taxes collected to the appropriate authorities. Redballer does not offer legal or Tax advice, so please be sure to check with your own Tax advisor about any applicable Taxes in your country. Whether you collected taxes or not for applicable event, In the event that a government authority requires Redballer to pay any Tax attributable to your use of the service, we will direct them to you but in situations where we are mandated to pay such taxes on your behalf, you agree to promptly and fully reimburse Redballer for such Taxes upon demand and all costs, penalties, interest and expenses related thereof.
(ii) You authorize Redballer to make available if required by applicable local, state, provincial, national or other law, rule, regulation, judgment or order, the gross amount of transaction details for which you’ve been paid in a given calendar year or in each month or day to day transactions and every other details that may be required including personal information.
(iii) Redballer reserves the right to withhold the payment of any amount owed to you hereunder and dispose of them as required by applicable local, state, provincial, national or other law, rule, regulation, court judgment or order, in each case as determined by Redballer.
(iv) We will fully comply with all relevant authorities, applicable local, state, provincial, national or other law, rule, regulation, judgment or order as regarding any and all existing Tax laws in your province, by using this service you agree that Redballer shall not be liable to you or any third-party for complying with relevant authorities.
4.17 COMMERCIAL ENTITIES.
From time to time, one or more Card Schemes may require that you enter into an additional agreement directly with one or more of our Payment Processing Partners or with the applicable Card Scheme or you may be mandated to comply with certain monetary rules in your country without prior notification. Typically this happens if your transactions exceed a certain amount of money as stipulated by applicable local, state, provincial, national or other law, rule, regulation, court judgment or by the payment processing partners, there may be a maximum transfer limit at a time or per transaction or on an annual basis in a given geography either as a policy of checkmating money laundry and other vices or other transaction/monetary policies in your country or by the payment processor.
Redballer will not be able to advice you on some of these rules and regulations especially as it relates to your country monetary policies please check with your bank and terms of use of partner payment processors.
4.18 ESCHEATMENT.
If your account has had no activity for a period of time set forth in applicable unclaimed property (e.g., escheatment) laws and we hold funds related to your account, then we will notify you as required by applicable laws. If you do not claim your unclaimed funds within the timeframe given to you, then we will escheat them to the applicable government authority in accordance with applicable laws.
4.19 HOW TO RECEIVE YOUR EARNINGS AFTER SALES OF TICKET.
Presently we pay earnings through paypal business account Due to it’s security features and wide acceptance, we will add others soon but for now you will be required to fill your paypal business account details as requested.
If you do not have a paypal business account or paypal has certain policies or restriction that makes it impossible to operate such account in your jurisdiction then that’s not a problem, you can send a mail to payment@redballer.com with the following details

We will only respond to request made through payment@redballer.com if such request was made using the same email address used in operating the account that created the event.
5.1 APPLICATION OF A POLICY GUIDE.
As a social global community where different event organizers converge for the purpose of providing convenient services on and through the service, redballer understands the need of providing a well-defined and well-structured trade agreement where each user will have a full understanding and full disclosure of terms guiding each purchase made on the service from individual organizer as those services are not offered directly by redballer. In other to ensure full customer/seller protection on the service redballer has created the following guidelines to govern refund policies for every purchase made on or from the service. By accepting the trade agreement, you agree to redballer’s refund policy guide without any waiver or modification and you wholly agree to be bind by this guide which will apply every time you create a paid event which will be sold on or via the service, promote, market or collect sales proceeds for a paid event.
5.2 INCORPORATION BY REFERENCE.
These Refund Policy guide and all rights and obligations contained herein are in addition to and are incorporated into the Terms of Service by reference. Nothing in these Refund Policy guide shall be deemed to modify, waive, amend or rescind any portion of the Terms of Service.
6.1 MINIMUM REQUIREMENTS.
We understand that refund policies vary depending on the type of event created by the event organizer and cost of event ticket. For that reason, we will provide flexibility for event Organizers to structure and incorporate their own refund policies into terms and condition governing their events, so long as they are in line with our refund policy guide:
(a) all event organizer must have a simple, very comprehensive and accessible Refund policies guiding every transaction on its page.
(b) Each event organizer must post its refund policy as part of terms and condition on its page.
(c) “No refund” policies are permissible, but must be clearly identified as such and must otherwise comply with these guides.
(d) Refund policies (including “no refund” policies) must provide for a refund or some form of repayment for complete failure to deliver (e.g., event cancellation).
(e) Refund policies must be in accordance with all applicable local, state, provincial, national and other laws, rules and regulations, including our terms of service, trade agreement and all requirements imposed by Card Schemes or Alternative Form of Payment Frameworks.
(f) Refund policies must include specific instructions on how to obtain a refund, including how, when and where to direct a refund request.
(g) Refund policies may not be changed with respect to purchases made prior to the date of such change and its posting to the terms and condition;
(g) Refund policies must set out a specific time frame within which refund requests will be responded to, which should not exceed five (5) business days for a first response; and
(h) Refund policies must otherwise be fair and reasonable.
If a refund policy is not posted or does not meet these guidelines set forth above, redballer may (but has no obligation to) modify such refund policy such that it meets these guidelines. Such modification may take the form of prospectively making changes to the actual refund policy on the applicable terms and condition set on the event organizer’s page or retroactively applying such changes at the time of a dispute, chargeback and/or refund request.
6.2 REFUND PROCESS.
In order to initiate a refund request, an event Attendee would contact the event Organizer directly as set forth in the organizer’s refund policy. Event Organizer agrees to administer its refund policy in accordance with the terms set forth on its terms and condition and the refund policy guide set forth above.
6.3 REDBALLER REVIEW.
Should an event Organizer fails to honor a refund as specified in its terms and conditions or as set forth in this refund policy guide. Once The attendee notifies redballer with the request and complaints redballer will immediately swing into action first we will discuss the issue with both the buyer and the seller then we will review the facts presented and circumstances surrounding the transaction in accordance with refund policy set forth by the event organizer via its terms and condition and our refund policy guide after which we will determine whether or not a refund is due, we will ensure that review and refund process is completed and final decision taken and communicated within 30 days of our investigations.
In other to protect members of our community, event organizers agrees that we can at our discretion ban, suspend or restrict any event organizer that fails to honor its refund policies and brand promises made to attendees.
all decisions reached by redballer regarding all refund complaints and request including without limitation orders to refund an attendee and amount of refund shall be final and binding on both the event organizer and its attendee of which failure to honor may at our discretion lead to a ban, suspension or restriction of service.
7.1 NO INSURANCE/NO GUARANTEE.
This refund policy guide is not intended to be and do not constitute an offer to insure the performance of or to guarantee the performance of any event Organizer or event attendee and do not guarantee that refunds will be issued in all given situation.
8.1 CREATING EVENTS THROUGH YOUR ACCOUNT
When you create event on redballer you will automatically be referred to as the event organizer or owner you may add more leaders or team to the event but you are still the owner of the event and as the main event owner, you have some responsibilities and they are outlined below.
So as to avoid any possible issue that may arise from sells of your event tickets its important you define expectations in clear terms and in ways that your event attendees will understand, to this end we advise that you
(1) Sales of event tickets
Before creating event on the service please ensure that everything relating to the event have been taken care of, for example you have booked the event venue, performing artists have been booked, event planners and vendors have been hired, sound systems for the event has been purchased/hired, the stage is set, hotels and accommodation booked, parking arrangement settled and every arrangement that will ensure a successful event have been taken care of.
We understand that sometimes even the best planned event could go wrong imagine having an unexpected technical hitch just few seconds before the headline act goes on stage or for some reasons artists paid to perform didn’t show up or some natural disaster just played out, you tried your very best to fulfill all promises made and things didn’t work out as planned. We are human after all and we cannot be so perfect neither is it humanly possible to anticipate what may happen in the next few minutes but the way and manner that you handle challenges experienced in the course of planning an event is the only thing that will count at the end.
So as to give your event attendees the best experience every time, we advise that you apply these rules
We want to ensure that all disputes that may arise from all transactions is amicably settled so as to promote a healthy relationship between the event organizer and event attendees we will do our best not to meddle into issues except when the need arises or if we feel that such issue may hurt our brand’s reputation.

We always advice that before you create event please ensure that every possible arrangement has been made so as to avoid event cancellation but in situations where event cancellation or postponement is unavoidable, we will advise the followings.
Please do not make refund without evidence. For example, do not make refund directly from your pocket to the person such refund may be denied and we will not be able to defend such refund.

10.1 PROHIBITED MERCHANTS.
By registering on the Service and accepting this Trade Agreement, you represent and warrant that:
(a) You are not located in or reside in any of the country in which the African union, United States, United Kingdom, European Union, Australia or Canada has embargoed goods or services of the same type rendered on the service;
(b) You are not a person or entity or under the control of or affiliated with a person or entity that is indicted or listed as a fugitive or associated with terrorism or fraudulent activities in any country of the world or wanted in connection with a crime or subject to sanction in any country of the world.
(c) You are not listed in the MasterCard terminated/prohibited merchant database or Visa terminated/prohibited merchant database or a terminated/prohibited merchant of any credit/debit card used on the service, ensure that your right to access each Card Scheme and each Alternative Form of Payment used on the service is not presently revoked or suspended.
If you fall into any of the categories set forth above, as determined by redballer in its discretion, you are a “Prohibited Merchant.”
10.2 Prohibited Events.
You are not allowed to post events on the Service that:
(a) Violates or facilitate the violation of any applicable local, state, provincial, national or other law, rule or regulation;
(b) Would be prohibited under the Payment Scheme Rules;
(c) Take place in Restricted Countries; and
(d) Contain any Content (as defined in the Terms of Use) that would violate the Terms of Use.
Any event that falls into any of the categories set forth above, as determined by redballer in its discretion, is a “Prohibited Event.”
10.3 Prohibited Transactions.
You are not allowed to process any of the following transactions and you represent and warrant that you will not submit such for processing through the Service:
(a) Any transaction that would violate the Payment Scheme Rules;
(b) Any transaction that is fraudulent or criminal in nature;
(c) Any transaction for embargoed goods and services.
(d) Any transaction to or from a restricted country.
(e) Any money laundering and gambling transaction disguised in any form so as to make Redballer and its payment processors believe that it as a payment for a legitimate listed event, and
(f) Any transaction that would constitute sending money to another party other than for the purchase of bona fide tickets listed on the site, or solicitation of a donation for a legitimate cause, events, or sale of items related to such events.
Any transaction that falls into any of the categories set forth above, as determined by Redballer in its discretion, is a “Prohibited Transaction.”
10.4 REMEDIES.
In the event that Redballer discovers that you are a Prohibited Merchant or that you listed a Prohibited Event or that you attempted to process or processed a Prohibited Transaction, then Redballer may take any or all of the following actions in its discretion in addition to any and all remedies that Redballer may have under the law or elsewhere in the Terms of Service:
(a) Suspend or terminate your Redballer account;
(b) Alter, edit, or remove any Prohibited Event or product or any portion thereof;
(c) Block, reverse or refund any or all of your transactions;
(d) Hold any and all funds associated with your account to the extent required by applicable local, state, provincial, national or other law, rule, regulation, judgment or order; and
(e) Refer you, your event(s) or your transactions and information relating to the same to our Payment Processing Partners, the Card Schemes, the Alternative Form of Payment Frameworks and/or applicable law enforcement agencies for further action.
Redballer’s country and regional offices may offer certain additional offline and online services from time to time that goes beyond basic functionalities or services of the site for which our country or regional offices may charge certain fees as agreed by both parties (redballer’s country or regional office and you) it’s important to note that each redballer’s country and regional office operates independently from the site and offer services that may be different from what is offered on the site. these additional services may marketing and promotional services, event support services, providing on-site entry management service, assisting in setting up your events, managing your events online or offline, providing dedicated account management services, professional consultant services for your event, social media consultants for your brand, online brand marketing and strategy development and other additional services provided prior, during or post event. All agreement reached between our country or regional offices and the Event Organizer shall be deemed as part of services rendered by the country or regional offices of redballer and fully without any waiver be subject to the site’s terms of service, terms of use and the site’s privacy policy. Such additional service may have additional terms of service or other written agreement or memorandum of understanding reached between our country or regional offices and the person or company to whom the service is rendered to. The additional terms reached between both parties regarding the additional service including fees shall legally bind.
In addition to the representations and warranties contained herein, you represent and warrant to us that
(a) if you represent an entity, that entity is duly organized, validly existing and in good standing under the laws of the state, province or country of its formation;
(b) You, or the entity you represent (if applicable), have all requisite power and authority to enter into this Agreement and to carry out the transactions contemplated hereby.
(c) the entering into and performing of this Agreement by you, or if you represent an entity by the entity you represent, will not result in any breach of any applicable local, state, provincial, national or other law, rule, regulation, judgment or order, or other agreement to which you are a party to, including without limitation, any other agreement for the sale of tickets, and
(d) If you represent an entity, you have the full right, legal power and actual authority to bind such entity to the terms and conditions hereof.
In addition to our right to terminate your use of the Services under the Terms of Use, Redballer may terminate this Trade Agreement and your right to use the Service to create, promote and collect sales proceeds for a paid event
(a) If you are in violation or breach of any provision of this Trade Agreement; or
(b) if our Payment Processing Partners and/or the Card Schemes or Alternative Form of Payment Frameworks in their sole discretion terminates our right to provide Services to you or your right to accept payments via their service or our service.
